How do Walmart deliveries work?

Walmart claims that its private fleet of 12,000 Class A drivers travels more than 900 million miles yearly – delivering merchandise to Walmart and Sam’s Club locations across America. Most of these Class A drivers (drivers with a commercial driver’s license who can drive tractor-trailers and rigs) deliver products from retailers and Walmart warehouses to other Walmart warehouses throughout the country, including Pennsylvania.

Most of the deliveries to consumers (residences and businesses) are made by independent contractors who use their own delivery trucks and vans.

The requirements to qualify for a Walmart driving position or a Walmart “Spark” Driver include:

  • Drivers need an Interstate (Class A) Commercial Driver's License with a Hazmat endorsement. The driver must pass a background check. Drivers can obtain the HAZMAT endorsement within 120 calendar days from the hiring date.
  • Drivers must have at least “30 months experience working in a full-time Class A tractor/trailer driving position in the previous 4 years.”
  • Drivers must have “No more than two (2) moving violations while operating a personal or commercial motor vehicle in the last three (3) years.”
  • Drivers should not have any serious traffic violations or preventable accidents while operating a commercial motor vehicle in the prior three years and no preventable accidents that result in a catastrophic injury or death while driving a commercial motor vehicle.

Generally, independent contractors must:

  • Be 18 years of age or older
  • Have the proper amount of liability insurance
  • Have a valid US driver’s license
  • Pass a personal background check and a motor vehicle record check
  • Act as an independent contractor
  • Agree to undergo a background check that includes a criminal background screening and a motor vehicle records review

Walmart can be vicariously (directly) liable for the negligence of any of its employees. Walmart often supplies its own trucks to Class A drivers.

Walmart may be liable for the negligence of independent contractors under certain limited circumstances.
