Ted Kennett Presents at the Lancaster Bar Association
Ted Kennett recently presented a continuing legal education program for other attorneys at the Lancaster Bar Association.
Ted’s presentation dealt with the April 16, 2013, decision by the United States Supreme Court decision in U.S. Airways v. McCutchen and explored the practical impact of the Court’s decision in McCutchen. The McCutchen case dealt with an issue that impacts all aspects of injury law and will likely have a significant impact on plaintiff’s. When an injured person’s health insurance pays for bills related to a personal injury claim, the health insurer may be entitled to be repaid from the recovery made in the negligence case. While plaintiff’s attorneys must be able to maximize a client’s recovery from the negligent party, attorneys must also be able to deal effectively with the health insurer’s claims for repayment. If the plaintiff’s attorney does not deal with the health insurer effectively, it can have a detrimental impact on the net amount the client receives. Every dollar that must be paid to the health insurer reduces the amount the injured person nets.
